Authority of Inspectors to Penalize on Minor Issues, i.e. placing of spittoons, grade of whitewash etc. abolished

Before: Pre-Partition Factories Act prescribed minute details like placement of spittoons and grading of whitewash. Inspectors used to penalize businesses for small violations.

After: Businesses are now permitted to implement hygiene measures according to best practices. Inspectors can no longer issue challans for having fewer spittoons or for the specific grade of whitewash used.

DetailsDifficulty● With factories now moving towards automation, some requirements under the relevant Factories Act are redundant. One such requirement is that of keeping spittoons or specification of whitewashing grades etc.
● For automated factories, this is a nuisance as it contradicts the automated/modern practices they have introduced in the factory.
AnalysisAfter discussions it was decided that the law needs to be made more flexible. Inspectors should not call out factory management for not placing spittoons, as it is unnecessary.
SolutionThe decision to have spittoons and their placement is now at the discretion of factory management. It is no longer mandated by law, and inspectors cannot impose penalties for this.
